These booking Terms and Conditions (“Terms”) apply to the booking of TES DUDE Electric (booking) and form a legally binding agreement under the Information Technology Act, 2000, as amended, between You and TES ELECTRIC PVT LTD, a company registered and having its registered offices at TES Electric Pvt Ltd, padinjarachira Road, M G Road, Thrissur, Kerala, India 680 001.
For the purpose of these Terms, wherever the context so requires “You/Your” will mean any person who has agreed to place the Booking of TES DUDE Electric vehicle through the website. The term “We/Us/Our” will mean TES ELECTRIC PVT LTD .
1. Booking
By placing a booking with Us, You express Your intention to purchase the vehicle specified by You (“Vehicle”) and agree to be bound by these Terms. Your purchase of the Vehicle and delivery by Us will be subject to Your compliance with the Terms hereunder and other applicable laws, regulations and guidelines.
2. Booking Amount
1. The booking Amount of Rs 2 000 shall be paid by You through the link provided on this Site. This shall be a non-interest bearing and will confirm Your booking. The same shall be construed as an offer from your end and shall be adjusted against payment of the final Vehicle price by You. Upon the receipt of the amount in the Bank Account of TES, we shall communicate the acceptance of the Booking, however, The acceptance of the Booking does not be construed as completion of the sale of the TES DUDE Electric vehicle as it is subject to the payment of balance amount, documentation requirements and terms and conditions.
2. The advance amount/booking amount paid by you will not attract any interest in what so ever manner even in case of the refund is sought by you for the reason of cancellation of the booking or if the advance amount/booking amount is adjusted to towards the full payment/cost of the Vehicle.
3. Price of the TES DUDE Electric Scooter
1. The Price displayed on the vehicle displayed, if any, on the website of TES is only the ex-showroom price of the vehicle. The On-Road price is subject to road tax, accessories charges etc., The final Vehicle price is the prevailing price as applicable on the date of intimation regarding final Vehicle payment. The balance sale price (i.e. balance sale consideration) shall be paid directly to the dealer(s) notified by TES.
2. Please take note that TES is only receiving the Booking Amount as a facilitator to promote the sale between the TES dealer and You. The actual transaction of the sale is a contract between You and the TES Dealer with whom you shall be making the payment of balance sale price.
3. TES shall not be responsible for any non-receipt of the Booking Amount to the Bank Account of TES due to technical or other reasons in the payment gateway or banking network issues
4. Delivery Schedule
We/our dealer will communicate the estimated delivery period for Your Vehicle and will make all commercially reasonable efforts to deliver Your Vehicle within the specified delivery period by the dealer notified by us. Any change or delay in the delivery period will be notified to You by Us/our dealer. We will not be liable for any claims, damages, losses, costs or expenses incurred/suffered by You due to delay in delivery of the Vehicle by Us. However, in the event of any delays, You may cancel and claim a refund of Your Pre-Order Amount in accordance with these Terms.
5. Cancellation/Refund
1. The refund of booking amount can be processed after deducting of INR.300 as a cancellation fee (applicable for online vehicle booking). Booking Amount shall be refunded by TES Electric Pvt Ltd after deduction of cancellation fee.
2. If any online booking amount and other amount paid by the Customer to the TES Electric Pvt Ltd towards the price of the TES Dude Two wheeler, The Customer has to claim the said amount from the TES Electric Pvt Ltd and no online transaction shall be made in this regard. No cash payments would be made by the TES Electric Pvt Ltd to the Customers. TES Electric Pvt Ltd Shall pays back the booking amount through bank cheque on the name of customer only.
3. In the case of financed orders, cancellation request shall be sent to the TES Electric Pvt Ltd through the financing entity and refunds will be made by the TES Electric Pvt Ltd to the concerned financing entity only.
4. The Notice of cancellation should be sent to the TES Electric Pvt Ltd together with the electronic customer copy of the Order Booking Form if any and the payment receipt. Once cancelled, Customer Order cannot be reinstated at the same Booking Reference Number.
5. No cancellation of any booking shall be entertained after generation of Invoice in the name of the customer by the TES Electric Pvt Ltd for any reason.
6. Refunds on booking amounts will be made within 15 days from the date of cancellation.
6. Assignment or Transfer
You acknowledge and agree that Your booking is for delivery of Vehicle only to You and You may not transfer or assign rights granted to You under these Terms to any third party.
7. Collection of Information
We may require certain information and documents from You for processing Your booking, complying with statutory requirements, and/or conducting a site inspection for installation of the Vehicle charging station. You represent and warrant that all such information and documents will be true, complete and accurate. You will promptly notify Us of any change in the information provided to allow Us to update Our records. All collection, storage, use and disclosure of any information provided by You will be in accordance with Our Privacy Policy available at https://www.teselectricscooters.in/
Site Inspection
Post Booking, We shall conduct an inspection of Your site for installation of the Home Charging station. The installation of the charging station may entail additional costs to Your account as may be determined by Us during such inspection or at the time of installation. If the site is not feasible for deploying the said charging station, then we shall notify you of the same. You may choose to cancel our booking in that case.
8. Territory
The Vehicle is available for booking or sale in such territories as may be designated by Us. You may not place a Booking for delivery of the Vehicle or request for installation of the charging station outside these territories.
9. Purchase Terms
These Terms are applicable to the Booking of the Vehicle. You acknowledge that purchase of Vehicle will be subject to such additional terms and conditions as may be prescribed by Us including without limitation, the TES DUDE General Terms and Conditions(collectively, the “Purchase Terms”). Such Purchase Terms are subject to change, and We recommend that You carefully read and understand all the prescribed Purchase Terms before proceeding with the purchase of the Vehicle and making the full payment.
10. Limitation of Liability
We will not be liable for any indirect, special, incidental or consequential damages arising out of or in connection with these Terms. Your sole and exclusive remedy and Our aggregate and cumulative liability for any material breach under these Terms will be limited to refund of the Booking Amount in the amount of valid cancellation.
11. Disclaimer
The Vehicle will in all material aspects be similar to the Vehicle presented or advertised in marketing or promotional campaigns. However, in view of Our endeavors to continuously innovate and improve Our products, We reserve the right to modify or alter the specifications, features and/or design of the Vehicle without prior notice and any liability.
12. Miscellaneous
1. We will not be responsible for any delay or failure to perform Our obligations under these Terms, where such delay or failure is due to any reasons beyond Our reasonable control.
2. In the event any of these Terms is held invalid or unenforceable, the legality and enforceability of remaining provisions will not be affected or impaired thereby. These Terms will be subject to the laws of India and any dispute hereunder will be subject to the exclusive jurisdiction of the courts at Thrissur Kerala.
